Manifesto

Nepal is a multiethnic, multilingual, multicultural and multireligious country. To this date, the political transformation has achieved only a trivial political benefit by the state and the polity; the majority of people did not witness any glimpse of changes in the region of social, economic, religion and culture. The major reason behind these lacking are thus not involving the majority of ethnic groups, minor community and multireligious people in every aspect of equal state liability, resources and policy making. These marginalized sociocultural groups, minority communities and women are discriminated by the state in terms of their cultural identities.


All the groups and communities thus living in Nepal are Nepalese. Each community language is a national language. Each community religion is a national religion. But the state is dominating and discriminating the marginalized sociocultural groups and minor communities on basis of their religion, cultural and dialect norms by implementing the singular norm of particular community (favor by the ruling state) in terms of one dialect, one religion and one culture. This has not only proven that sociocultural groups and minority are being treated as a second class citizen by the state but has also deliberately disrespected the consensus of UN and World Human Right Organization by excluding them from participating in national growth and the rights of their cultural identities, values and recognition.
 

Thus for the Nation growth, harmony, sovereignty and unity, the Central Federal Government of equal proportional representatives (On basis population) from all the groups and women is the only necessity resolution so that it ensures fair distribution of resources to different groups, and promotes justice to various sociocultural groups and minority by sharing power. Under these criteria the specific law and accommodation shall be preserved as reservation for marginalized sociocultural groups, minor and under privilege communities, and women to prosper and develop in the sector of education, employment, civil service, industry etc. Hence the Rastriya Janamukti party shall be forever committed to marginalized sociocultural groups, minor communities and women for their socio rights, cultural development, justice and economic prosperity.
 

The model of secular state, decentralized government, federal state (Under geographical sphere) and state autonomy government (Equal Proportional representatives of all the groups and communities) are the principal theory of the party for building the new dynamic Nepal.


1. Central Federal Government and Autonomy Government
Central federal government holds the administration of foreign affairs, defense, communication, trade and commerce, currency and a few state owned industries. The Autonomy State government holds the administration of economic, politic, religion, social, culture, dialect and script, state development and growth.

2. Proportional Representative and Reservation:
For the state growth and policy, representative of all the groups and minor communities are essentially included on basis of equal proportional of their population. The minor and under privilege, backward, extinction groups and women are provided more priority in education, industries, employment and further 50% of privilege shall be increased from their respective proportional representative reservation. The central government and the state autonomy government shall legitimize reservation for minor groups, backward nationalities and extinction groups in field of education, employment, industries and government services.

3. Form of Federal Government:
Transforming the current government of unitary system to central government of integrated autonomy states is the Federal Government. Central Federal Government shall form two councils, the National Council and the State Council. National Council in place of current House of Representatives (Lower House), and State Council in place of current National assembly (Upper House). In the Lower House (National Council), the equal proportional representatives of different political parties from all the autonomy states are elected by the closed poll from equal proportional election system. In the Upper House (State Council), elected or nominated representatives from all the autonomy states are proportionally assembled under particular revised numbers. In National Council, majority of elected party shall rule the federal government as Federal Council in place of current cabinet ministries.

In Autonomy State of Federal Government, elected representatives from all the political parties are assembled in People Council and initiate the regulation for autonomy state. In absence of People Council, regulation shall be carry out by equally formed Local Council. Members (On basis of revised numbers concluded by the autonomy working committee) for Local Council are included from:

       1. Members elected from emergency situation on basis of total numbers of elected political party    representatives from People Council.
        2. Members from significant, contributing, minor and backwards groups and women.

        All the rank and position of the members shall be determined by the cycling system.
       Majority party from People Council and Local Council forms autonomy working committee and    nominates or elects the members on basis of specified numbers.

4. Relation between Central Federal Government and Autonomy states Government


         4.1. Referendum shall be imposed in particular autonomy state government If in the case of a conflict occurs between the central federal constitutional law and the autonomy states jurisdiction law. According to the majority of Referendum polling, Central Federal Government and the Autonomy states Government shall amend the law and constitution. The constitutional law of Central Federal Government has the only rights in Nation goodwill and interest but holds no authority over interfering Autonomy State constitutional law or in any state growth, development and government bodies.

        4.2. Central Federal Government helps funding or donates sum proportionally to all the autonomy states from its collected tax in imported goods, collected tax from central government owned industries and assets, and joint or single accord of financial support or donation sum from the ally nations.

5. Relation between Autonomy States.
 

For the state goodwill, Autonomy state shall have all the rights on forming good relationship with other autonomy state under joint agreement or treaty. The agreement or the treaty shall be legitimized by the Central Federal Government. If Central Federal Government fails to legitimize the treaty, referendum polling will take place on particular autonomy state for the right decision. Later the decision shall be accepted by the Central Federal Government.

6. Responsibility of Autonomy States.


       
6.1 Autonomy state guarantees:
             (1) Security for human rights, people liberty and freedom, health, education and employment.
             (2) Education in native dialect facilities, research programs in native dialect and scripts, cultural tradition and religion.
             (3) Use of native language in government firms and offices, and equal rights to all the native dialects.

       6.2 Responsibilities of Autonomy State Government will be of people rights and security, handling tax, justice, land planning, donated land to society and land tenants security, police department, civil servant, banking facilities, hospitals and clinics, industries, transportation and communication, modern agriculture scheme, state growth development, program for people welfare and industrializing the state.

7. Reservation for Election Region.
Government of Rastriya Janamukti Party will reserved the election region under particular percentage for all the groups, minor, backwards and the women representatives in equal proportional basis for the National Council and Local Council.

8. Secular State.
Nepal shall be declared as a Secular state, all the religions are treated with equal respect and reverence and all the autonomy states shall be legally advised to pursue it.

9. Foreign Policy.
Considering the Nation tall interest and goodwill, foreign policy shall be commenced on basis of equal bilateral terms and conditions under UN manifesto, international laws and the World Peace resolution. Visitors from joined neighboring countries and locals shall be provided and kept the respective permit pass.

10. Treaty and Agreement with Neighboring Countries.
All the past treaties and agreements made under national interest and friendship shall be kept untouched. But the treaties and agreement made against national interest or goodwill shall be either cancelled (considering the time factor) or eradicated.

11. Legal System
Capital Punishment shall be eradicated from the legal system. Considering the Human Rights and humanity, any kind of physical abuse or torture implemented to criminal or apprehended person will be against the law and order, and if one is reported or recorded in such cases then the one shall be charged and punished under proper legal law. Authority has no rights to arrest person without the proper warrant, the apprehended person within 24 hrs must be submitted to justice court for the legal right settlement and justification. The authority holds no legal ground for keeping apprehended person in jail or custody without the court proper decision. For the financially disables and women, legal processes shall be provided free of cost by the government. Regardless to any rank or class, corruption, racketing, women trafficking, smuggling drugs, traitor to state, rapist, abusing authority, fraud traders, disrespecting others religions and cultures, and racial activities are legally charged under basis of condition from five years to life sentence. But if proven innocent and not guilty from the justice court, the person shall be compensated by the Government under basis of one’s rank and class. Practicing of long and enduring justice processes of Nepal shall be transformed into more scientific and efficiency method for the convenience of the people. Case of child, women, disable, mentally retarded and over 70 yrs of age will be arranged exclusively within 6 months of time. The Justice system of Nepal shall be made more efficient, reliable, dynamic and fair.

12. Independent Court of Justice.
Under constitutional entity, Civil and Criminal Court of law shall be established in every autonomy state and central division. For the convenience of the common people, Peoples Court shall be established at the local level for an efficiency and transparency of larger or smaller cases filed under robbery, fraud, humiliation, raped, couple dispute, heritage, loans, brawl, accusation, public crime, and land dispute. If one is discontented from the People Court, one could further appeal in Appellate Court. Jail sentenced of 10 yrs or more from the Criminal Court, fined of 50 thousands or more from the Civil Court and the bilateral cases between autonomy states shall be eventually handled by the Federal Court in the central level. Court of Justice shall be kept independent of any kind of government interferences for the transparency.

13. Election Constitution
For the state fair election, independent Election Constitution will be formed in central and autonomy states and will remain one of a constitutional entity.

14. Civil Service Commission
For the state civil service and promotion, appliers are fairly appointed on qualification basis by the Civil Service Commission, and except in special civil services, reservation shall be provided for all the groups and minors on basis of equal proportional system. Terminating civil servant without the proper clarification and justification will be illegal and not authorized.

15. Economic Policy
Independent and competitive market under democratic system shall be the party economic policy. Most of the Nepal industries are technically and materially much behind the other developed countries, thus it is against state interest for granting total independence to all the industries. Approaching the essential help from the neighboring nations has mostly been a setback to the nation. To this date, the state owned industries have been a failure in every respect. Embracing a practice of corruption by the corrupted government in every unit of the government sectors is the main reason behind the failure and fiasco of the state owned industries. Thus a new policy shall be strongly implemented for the enhancement and corruption free government. Since the Industries of large scale power house generators, large scale compost industries, communication transportation, mine industries, overseas donated industries, and Nuclear Power Plant are significantly important to the state then it is appropriate and right of the state to govern it. And remaining industries shall be remained independent and competitive under the local or non local industrialists. Independent industries must ensure and guarantee on labor proper share, labor rights and the employment. For developing and maintaining industries in rural areas, government shall distribute necessary capital to the people for participating in growth of industrialization; this will not only ends the trend of a few elite from controlling the state economy and capital but also help decentralizing industries from the urban to rural areas. The local and non local industrialist shall be offered equal independence and healthy competition in open market policy of the state, however the local industrialist shall be protected and made more proficient and competitive from the pressure and standard of non local industrialist. Massive researches shall be pursued on area of petroleum and mine for its production as well.

      15.1 Industrial Policy: As a state main resource, modern industrialization will remain the Party’s principal objective. Initially the Central Federal Government and the Autonomy States shall provide priority and roof for the agricultural industries. Since Nepal is a development country and its industries are in frail condition, government shall always provide support and services to the industries development and its growth. The policy of protecting local industries from the overseas industries and involving the local industries to each other in a healthy competition shall be formulated. And the local industries that promote and export local goods in overseas market shall be acknowledged and well received. Acknowledged industries shall have advantage of receiving long term loan on minimum interest rate for its important role in the state development and growth. Considering the state interest and goodwill, investors from overseas shall be advised and supported to invest or open up more industries in the state, and for their convenience electricity (in minimum rate), industrial region, transportation and legal processes are made more uncomplicated by the government. Overseas investors are given right on acquiring some of the profit from total profit on particular interest to remit home. Trading in currencies will also be made convenient and uncomplicated.

    15.2 Land Reform: Till this date, Nepal economy is particularly relying on agriculture. But the agriculture of Nepal has been a subject of discontented, poor and defamation, in spite of approaching and implementing modern technique, most agriculture of Nepal has to rely on rain fall in 21st century. Considering these facts, the Party shall transform and revolutionized agriculture into a more vibrant and much productivity sector of the state. Appropriate land reform shall be initiated to limit the agricultural mounting pressure and gradually transforming it to industrial sector. State owned lands shall be distributed or divided to the landless citizens and to poor farmers either in minimum cost or free of cost according to the citizen circumstances. The poor shepherds from hills and mountains, farmers of containing 10 ropani lands in Hill Mountain and 1 Bigha land in Terai regions are granted free land tax. And tax system is not only based on land but in irrigation as well. Proper legal law will be formulated on Land tenant rights system.

   15.3 Landless Citizen Reform: Due to poor and redundant policy of the state, many farmers and poor have become a landless citizen and are compelled to live in the unoccupied government lands, this crisis has become a major issue and a tragedy to the state. To resolve the crises, government shall provide priority (if possible) of granting landless citizen the right to continue living at government lands. On first phase, each citizen from one family shall be provided employment from the government.

  15.4 Agriculture Reform: Region shall be divided on basis of its productivity and conveniences and shall acknowledge the resolution be firmly followed in all the Autonomy States government. Farming of sheep and yak (mountain cows) in mountain region for cheese and cotton production, Farming of fruits, tea, garlic, coffee, goats, chickens, pigs, cows and buffalo in hilly region for milk and meats, Terai (Southern flat land) and Middle Belt (Between southern flat land and northern hilly range) region for agriculture productivity.

  15.5 Labor Reform: Skilled and minimum trained (On subject of Industries) labors are guaranteed of permanent employment, free accommodation, medical and treatment, education for family, insurance, bonus and proper compensation in case of unanticipated accident. Only 8 hours of working time is regulated minus no over time bonus system.

  15.6 Tourist Reform: Since Nepal is undoubtedly a one of the finest tourist destinations in the world, significant, religious, historical and other important places shall be provided more priorities for the tourist attraction. Tourists shall be encouraged to visit not only in geographical sphere but also in traditional and cultural sphere of the state as well.

  15.7 Rivers and Electricity Production: Vast water resources of the state shall be exploited in generating electricity, transportation, irrigation, ducks and fish farming etc. Generating electricity on large scale shall be only approved or built if neighboring countries will guarantee to purchase or reconcile under certain conditions, else considering the green environment, the state shall generate and produce the hydro power electricity only according to the appropriate volume of electricity required for the state. Electricity (for the motor or pump) shall be made accessible for drinking water and irrigation as well. Immense water resources of the state shall never be compromised against the national interest.

  15.8 Transportation: In Nepal, all the major highways are either built or financially supported by the neighboring countries. This trend has proven many setbacks rather than an enhancement. For example, all the materials, raw materials, and experts have to be imported, thus proving high maintaining cost, constant dependable and large scale budget for the foreign experts. On the contrary to this trend, operating cable car, trolley bus, tram and electricity train and rope way for cargos in hills area through electricity shall be instigated for the convenient service of the people. And setting this trend shall reduce the costly imported demand of petroleum and diesel as well.

16. Health:
At least one modern equipped hospital (of 150 beds) shall be built according to every 50 thousand populations of the state. And each clinic shall be built in each village development committee and the poor shall be provided of free access to medical and health treatments. Promotion and education facilities of doctors and health compounders shall be entirely dependent on basis of their services to rural areas.

Government shall encourage and provide more help to parents comprising of only 2 babies and shall emphasize more in the family planning awareness to control population growth and reducing child death rate. Free maternal medical treatment, family planning facilities and free medical supply shall be promoted and launched.

17. Drinking Water:
First priority of the Government will be to develop healthy supply of drinking water to each village. And the appropriate water resources shall be researched, located and accumulated to put an end to the water crises of Kathmandu valley and the other cities.

18. Communication:
Entire communicational departments of the state shall provide service in different languages of different groups in equal proportional ratio. All the languages shall be included in the Government papers and newspapers. Entire villages to all the major cities shall have Post offices and telephones and the service of internet/email if possible.

19. Education System:
Education in all the available native language shall be introduced and initiated according to the feasibility report and researches. Government shall grant support to those seeking education in mother tongue, but on contrary shall never support education system which is based on the priority of a single or a particular group values and norms. Education till secondary level in government schools shall be made free. Separate department (unit) shall be formulated for the development of diverse languages of ethnics and others by the Autonomy state government. Government and non government schools shall be maintained equally on basis of the required standard.

20. Renting & Tenancy:
Government will initiate appropriate law and regulations by preserving rights of both the tenant and house owner regarding unnecessary conflicts in renting, departing and rent increment.

21. Banking Service:
Each Rural Development Bank shall be formulated between the two villages development committees. if the farmer needs and accessories are insufficient or in the case of natural disaster or ruin of the basic needs then the service of long term loan on minimum or on zero interest rate without the required collateral shall be provided to them.

22. Overseas Service:
Department for Overseas Service and Ex-Military Service shall be formulated to preserve and guarantee the goodwill of overseas employees, British/Indian Gurkhas army and police force (Under Tripartite Treaty).

23. Men Power & Trade:
Processes of supplying men power through the private agencies shall be eliminated. Thus Government shall over take the task of men power department for the necessary management and processes for appointing and supplying the men power. The service of providing loan (on future pay back system) by the Government will be available for the financially underprivileged appointees. Custom rate and clearances for overseas employees shall be maintained and facilitated according to ones earning resources. Petite traders and businessmen shall be provided facilities on custom of tiny baggage and luggage and efficiency in foreign currency exchange. According to ones earning resources, importing gold shall be granted. All the foreign workers shall be granted employment on basis of Work Permit system.

24. Unemployment Pension (Dole Money):
For each tax paying citizen will be provided necessary employment according to the qualification and skill. Dole money shall be provided to unemployment and pension to above 60 yrs of age citizen.

25. Citizenship:
Citizenship shall be provided by the Autonomy State government to each Nepali residing under Autonomy State. Citizen having more than one lands and houses in the autonomy states has to nominate particular state for his/her required citizenship. Citizenship Enquiry Commission shall be formed in each Autonomy State comprising representatives of leading people  to grant and consider required citizenship to the inhabitants of the state.

26. Special Prospect:
Government shall provide total support and help to under privilege, poor, disables, orphans, shabby, beggars, mentally disables, and women in education, medical treatment, shelters and humanity development. Government shall reform the jail of cruelty into Correctional House for the humanity of the convicts. Necessary needed help and support shall be provided to the children of national or international Nepali army and police force for proper education, health and employment. Activities of racketeering and fraud shall be controlled and maintained. Poor and under privilege people shall be distributed Ration Card for availability of low-priced accessories of medical, food and cloth donated by the Government to each village and city.

Conclusion, Aim of Autonomy Government is to eliminate cruelty, disrespect, hegemony, discrimination, supremacy upon one man to other and establishing equal proportional representatives from entire groups in mainstream political system and providing reservation rights on legal basis in education, civil services, employment, and in industries to the sociocultural, minor and backward groups under the same principle. Thus living under the roof of Federal Government and establishing the progress state of multi cultural and entire group of autonomy government shall be the main aim and principle of the Rastriya Janamukti Party.
